What Is a Witness Statement

A witness statement is a written record of evidence — a person’s account of events, set out in numbered paragraphs, signed with a statement of truth. It is one of the most important documents in any case. The court reads it before the hearing. The other side’s lawyers read it before the hearing. By the time you stand up to speak, your statement has already done most of the work — or undone it.

When You Need One

Civil Court Proceedings

County Court and High Court claims — small claims, fast track, multi track. Drafted to meet Civil Procedure Rules Part 32 and the relevant Practice Direction.

Tribunals

Employment, immigration, social security, mental health, and other tribunals. Statement structured to address the issues the panel will be asked to decide.

Professional & Regulatory Bodies

NMC, GMC, GTC, SRA, ACCA, and other professional regulators. Hearings at this level demand precision — statements drafted to the body’s procedural rules.

Insurance & Claims Disputes

Witness statements supporting personal injury claims, motor incidents, household claims, and disputes with insurers. Clear, factual, sequential.

Statements in Support

Supporting statements for applications, appeals, complaints, and proceedings — from neighbours, colleagues, family members, and other witnesses.

Other Proceedings

Council disputes, school admissions appeals, planning matters, leasehold disputes, and any forum where written witness evidence is required.

What Gets Statements Rejected

The single most common reason witness statements fail is that they don’t comply with the rules. Courts and tribunals can — and do — refuse to admit statements that:

  • Aren’t written in the witness’s own words
  • Mix evidence with argument or opinion (a witness states facts; advocacy belongs elsewhere)
  • Lack a properly worded statement of truth
  • Aren’t structured in numbered paragraphs
  • Refer to documents that aren’t exhibited or paginated correctly
  • Contain hearsay without identifying the source
  • Use inconsistent dates, names, or chronology
  • Don’t address the issues the court has been asked to decide

A witness statement isn’t a letter to a friend. It’s evidence. We draft it that way.
